STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nine
AN ACT allowing towns to apply for certification of local building codes for compliance with the Americans with Disabilities Act.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Enforcement of the Americans with Disabilities Act. Amend RSA 31 by inserting after section 9-c the following new section:
31:9-d Enforcement of Americans with Disabilities Act. Town governing bodies may apply to the attorney general for certification that a local building code establishes accessibility requirements which meet or exceed the minimum accessibility requirements for public accommodations and commercial facilities. When applying for certification the town shall hold a public hearing at which the attorney general shall be present where the public shall have the opportunity to testify for or against certification.
2 Effective Date. This act shall take effect 60 days after its passage.
