STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT clarifying a law relative to junkyards within industrial areas.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Junkyards; Industrial Areas. Amend RSA 236:103 to read as follows:

236:103 Industrial Areas. Notwithstanding any provision of this subdivision, junk yards, auto graveyards and scrap metal processing facilities may be operated within areas adjacent to the interstate system, [the federal aid primary system,] and the turnpike system which are within 1,000 feet of the nearest edge of the right-of-way and which are within a zoned industrial area, or which are within an unzoned industrial area but are used for industrial activities.

2 Effective Date. This act shall take effect 60 days after its passage.
