ANALYSIS

This bill requires a youth recreation program to accept a notarized statement of the child’s age and birthday rather than requiring a copy of the child’s birth certificate.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to identification required for participation in youth recreation programs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Identification for Participation in Youth Recreation Program. Amend RSA 170-E by inserting after section 50 the following new subdivision:

Identification for Participation in Youth Recreation Program

170-E:51 Youth Recreation Program; Identification Required for Participation.

I. A youth recreation program that requires verification of a child’s name, age, and birthday as part of its registration or participation requirements shall accept a notarized statement providing this information from the child’s parent or guardian. Under no circumstances shall the program require a copy of the child’s birth certificate.

II. In this section, “youth recreation program” means any program offering instruction or other organized activities for children, including but not limited to athletics, crafts, music, or dance, or other child care services, offered by a school, municipality, religious group, or other nonprofit organization, such as the Boys and Girls Clubs of America, Girls Inc., the YMCA, or the YWCA.

2 Effective Date. This act shall take effect January 1, 2010.
