AN ACT allowing the executive director of fish and game to donate certain hunting and fishing permits to the wildlife heritage foundation of New Hampshire.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT allowing the executive director of fish and game to donate certain hunting and fishing permits to the wildlife heritage foundation of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Wildlife Heritage Foundation; Donation of Permits. Amend RSA 206 by inserting after section 33-d the following new section:

206:33-e Wildlife Heritage Foundation; Donation of Permits.

I. The executive director may donate up to 5 fishing licenses and hunting licenses along with any necessary permits to take up to 5 moose, up to 5 deer, and up to 5 bear, each calendar year to the wildlife heritage foundation of New Hampshire, the official nonprofit partner of the department pursuant to RSA 206:33-c. The donated permits shall be used by the foundation to assist in its corporate mission. The donation of permits shall not affect the number of permits to be made available to the public by the department.

II. The licenses and permits donated under paragraph I shall be valid anywhere in the state open to the taking of the species selected, and shall be valid to take moose, deer, or bear of either sex during the established hunting season for that species. Prior to being issued a hunting license under this section, a person shall meet the hunting education requirements under RSA 214:23-a.

2 Effective Date. This act shall take effect 60 days after its passage.

HB 41 FISCAL NOTE

AN ACT allowing the executive director of fish and game to donate certain hunting and fishing permits to the wildlife heritage foundation in New Hampshire.

FISCAL IMPACT:

The Fish and Game Department states this bill, as amended by the House (Amendment #2009-0161h), will increase fish and game fund revenue by an indeterminable amount in FY 2010 and each year thereafter. This bill will have no fiscal impact on county and local revenues or state, county and local expenditures.

METHODOLOGY:

This bill allows the executive director of the Fish and Game Department to donate up to five fishing licenses and hunting licenses along with any necessary permits to take up to five moose, up to five deer, and up to five bear, each calendar year to the Wildlife Heritage Foundation of New Hampshire. The Fish and Game Department states although the proposed legislation does not derive a direct revenue advantage to the Department through the donation of licenses and permits to the Foundation; there is an indeterminable benefit derived through the Department’s partnership with the Foundation.

The Department states The Wildlife Heritage Foundation of New Hampshire’s corporate mission is to enhance, through private financial support, the critical conservation programs of the Department. Accordingly, the licenses and permits donated to the Foundation as a result of the proposed legislation would be used by the Foundation to raise additional revenue through auction or other promotion that will then be given to the Department. The Department states this will increase fish and game fund revenue by an indeterminable amount in FY 2010 and each year thereafter.
