STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT requiring dwelling units to have functioning smoke detectors upon their sale or transfer.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Fire Protection and Warning Devices in Dwelling Units. Amend the section heading of RSA 153:10-a to read as follows:

153:10-a Fire Protection and Warning Devices in [Multi-Family Dwellings] Dwelling Units.

2 New Paragraph; Sale or Transfer of Dwelling Unit; Automatic Fire Warning Device Required. Amend RSA 153:10-a by inserting after paragraph VII the following new paragraph:

VIII. The seller of any dwelling unit or multi-unit dwelling, occupied in whole or in part for purposes regulated by paragraphs I, II, or II-b, shall, upon sale or transfer of such dwelling unit or multi-unit dwelling, certify in writing on a form prescribed by the state fire marshal to the buyer that the building is equipped with functioning approved automatic fire warning devices in accordance with this chapter. Nothing in this section shall preclude the owner from using a complete automatic fire alarm system to meet this requirement.

3 Effective Date. This act shall take effect January 1, 2010.
