AN ACT relative to the transition of certain functions and reporting requirements of the community college system of New Hampshire and making an appropriation therefor, and relative to extending the report date for the community college system legislative oversight committee.

AMENDED ANALYSIS

This bill:

I. Changes the effective date for the transition of certain functions within the community college system of New Hampshire from July 1, 2009 to July 1, 2011.

II. Provides that the commissioner of the department of education and the chancellor of the community college system of New Hampshire shall annually issue a joint report on the proposed use and distribution of federal vocational funds.

III. Makes an appropriation for the purposes of this act.

IV. Extends the report date of the community college system legislative oversight committee to November 1, 2011.

V. Requires the chancellor and the board of trustees of the community college system of New Hampshire to submit a report by September 1, 2009 on the centralization and implementation of its business functions.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT relative to the transition of certain functions and reporting requirements of the community college system of New Hampshire and making an appropriation therefor, and relative to extending the report date for the community college system legislative oversight committee.

Be it Enacted by the Senate and House of Representatives in General Court convened:

148:1 Community College System of New Hampshire; Use of Financial Services. Amend 2007, 361:40, I to read as follows:

I. Paragraphs I-III of section 35 of this act shall take effect July 1, [2009] 2011.

148:2 Community College System of New Hampshire; Report. Amend RSA 188-F:11 to read as follows:

188-F:11 Report.

I. The commissioner of the department of education and the chancellor of the community college system of New Hampshire shall annually issue a joint report on the proposed use and distribution of federal vocational funds. Such report shall be completed by October 15 of each year and a copy shall be delivered to the chairpersons of the house and senate education committees, the speaker of the house of representatives, the president of the senate, the governor, the house clerk, the senate clerk, and the state library.

II. The chancellor and the chairperson of the board of trustees of the community college system of New Hampshire shall issue a [joint] report annually which shall include [detail on the proposed use and distribution of federal vocational and financial aid funds,] updates on ongoing upgrades to the information technology systems used by the community college system of New Hampshire[,] and an assessment of the overall operation of the community college system of New Hampshire including financial status, enrollment data, and program administration. Such report shall be completed by October 15 of each year. A copy of this report shall be delivered to the chairmen of the house education committee and senate education committee, the speaker of the house of representatives, president of the senate, the governor, the senate clerk, the house clerk, and the state library.

[II.] III. Each year the chancellor of the community college system of New Hampshire, as well as one representative from the board of trustees and the president of each institution shall appear before the house finance committee and the senate finance committee to review the system’s programs, cost analysis, revenue projections, and any other information detailed in the written report.

148:3 Appropriation. There is hereby appropriated the sum of $1 for the biennium ending June 30, 2011 to the community college system of New Hampshire to carry out the provisions of this act. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

148:4 Community College System Legislative Oversight Committee; Report Date Extended. Amend 2007, 361:37, VI to read as follows:

VI. Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the chairpersons of the house and senate education committees, the house clerk, the senate clerk, the governor, and the state library on or before November 1, [2009] 2011. If the committee concludes there are substantial concerns with the operation or administration of the community college system of New Hampshire, the committee shall include in its report detailed proposed legislation to remedy such concerns, including, if appropriate, additional legislative oversight and continued partnership with the state on certain duties and functions, or legislation necessary to return the community college system of New Hampshire to state agency status.

148:5 Community College System of New Hampshire; Report on Implementation of Business Functions. The chancellor of the community college system of New Hampshire (CCSNH), in consultation with the board of trustees of CCSNH, shall submit a report to the chairpersons of the house and senate education and finance committees no later than September 1, 2009 containing a plan which details the steps necessary to centralize all business functions within CCSNH and the procedures CCSNH will undertake to implement such plan. The report shall also include recommendations for proposed legislation if deemed necessary.

148:6 Effective Date.

I. Section 3 of this act shall take effect July 1, 2009.

II. The remainder of this act shall take effect upon its passage.
