STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study the collision repair industry in New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the collision repair industry in New Hampshire.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Four members of the house of representatives, appointed by the speaker of the house of representatives.

(c) Two members of the New Hampshire Automobile Dealers Association (NHADA), appointed by the association.

(d) Two members of the New Hampshire Collision Repair Advisory Group, appointed by the NHADA.

(e) Two representatives of the insurance department, appointed by the insurance commissioner.

(f) Two members of the insurance industry, appointed by the New Hampshire Association of Domestic Insurance Companies, appointed by the association.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties.

I. The commission shall study all aspects of the collision repair industry in New Hampshire, including:

(a) Interactions between the collision repair industry and the insurance industry and means of strengthening working relationships of entities within each industry.

(b) The role of the insurance department in the collision repair industry.

(c) Consumer protection and dispute resolution issues, including relevant statutes and enforcement mechanisms.

(d) The economic importance and future of the collision repair industry in the state.

II. The commission may solicit information and testimony from individuals, agencies, and organizations that may assist the commission in the performance of its duties.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

6 Effective Date. This act shall take effect upon its passage.
