AN ACT establishing a commission to study the collision repair industry in New Hampshire and establishing a committee to study the regulation of business practices between motor vehicle manufacturers, distributors, and dealers.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Nine

AN ACT establishing a commission to study the collision repair industry in New Hampshire and establishing a committee to study the regulation of business practices between motor vehicle manufacturers, distributors, and dealers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Commission Established. There is established a commission to study the collision repair industry in New Hampshire.

2 Membership and Compensation.

I. The members of the commission shall be as follows:

(a) One member of the senate, appointed by the president of the senate.

(b) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(c) One member of the New Hampshire Automobile Dealers Association (NHADA), appointed by the association.

(d) Two members of the New Hampshire Collision Repair Advisory Group, appointed by the NHADA.

(e) One representative of the automotive technology program of the community college system of New Hampshire (CCSNH), appointed by the chancellor of CCSNH.

(f) One representative of an automotive technical program at the high school or community college level, jointly appointed by the commissioner of the department of education and the chancellor of the community college system of New Hampshire.

(g) One representative of the department of environmental services, appointed by the commissioner of the department.

(h) One representative of the department of resources and economic development, appointed by the commissioner of the department.

(i) One representative of the insurance department, appointed by the commissioner of the department.

(j) Two members of the general public, appointed by the attorney general.

II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

3 Duties.

I. The commission shall study critical aspects of the collision repair industry in New Hampshire, including:

(a) The economic importance and future of the collision repair industry in the state, including technician training and development of future technicians.

(b) The environmental impact and regulatory compliance obligations of collision repair shops.

(c) Consumer protection and information disclosure related to collision repair, including ethical practices and performance services, dispute resolution, relevant statutes, and enforcement mechanisms.

II. The commission may solicit information and testimony from individuals, agencies, and organizations that may assist the commission in the performance of its duties.

4 Chairperson; Quorum. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.

5 Report. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2009.

6 Committee Established. There is established a committee to study RSA 357-C, relative to the regulation of business practices between motor vehicle manufacturers, distributors, and dealers.

7 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

8 Duties. The committee shall study the scope and application of RSA 357-C, relative to the regulation of business practices between motor vehicle manufacturers, distributors, and dealers. The committee’s study shall include, but not be limited to, the effect of changes to RSA 357-C made by 2009, 20 (SB 153 of the 2009 legislative session).

9 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

10 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library in an interim report filed on or before November 1, 2009 and in a final report filed on or before November 1, 2010.

11 Effective Date. This act shall take effect upon its passage.
