This bill allows dental hygienists to engage in direct access to the public for the practice of dental hygiene under rules adopted by the board of dentistry.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the practice of dental hygienists.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Rulemaking; Board of Dentistry; Direct Access of Dental Hygienists. Amend RSA 317-A:12, XIII to read as follows:

XIII. The direct access to the public for the practice of dental hygiene by licensed dental hygienists.

XIV. Other matters related to the proper administration of this chapter.

2 Practice of Dental Hygiene. Amend RSA 317-A:21-c, III to read as follows:

III. Dental hygiene services [shall] may be provided under the supervision of a licensed dentist in accordance with rules adopted by the board, or as provided in RSA 317-A:21-d.

3 Dental Hygienists; Direct Access. RSA 317-A:21-d is repealed and reenacted to read as follows:

317-A:21-d Dental Hygienists; Direct Access.

I. A dental hygienist licensed by the board may engage in direct access to the public for the practice of dental hygiene according to procedures and requirements in rules adopted by the board under RSA 541-A.

II. A dental hygienist engaged in direct access to the public for the practice of dental hygiene may maintain a collaborative relationship with a dentist, and may be directly reimbursed for services by patients, third-party payers, or any other entity.

III. The board shall appoint an advisory committee consisting of the 2 dental hygienist members of the board and 3 additional dental hygienist members. The advisory committee shall make recommendations to the board for the rules governing procedures and requirements of direct access to the public for the practice of dental hygiene.

4 Effective Date. This act shall take effect 60 days after its passage.
