AN ACT relative to participation in the state children’s health insurance program.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 State Children’s Health Insurance; Powers and Duties of the Healthy Kids Corporation. Amend RSA 126-H:5, II to read as follows:
II. [Coverage under the corporation’s program shall be secondary to any other available private coverage held by the participant child or family member. The corporation may establish procedures for coordinating benefits under this program with benefits under other public and private coverage.] No payment may be made under the corporation’s program with respect to an individual who is eligible for coverage under a group health plan or health insurance coverage offered through an employer, either as an individual or as part of family coverage.
2 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to participation in the state children’s health insurance program.
FISCAL IMPACT:
The Department of Health and Human Services states this bill would decrease state expenditures by $3,259,200 in FY 2010 and each year thereafter. This bill would have no fiscal impact on state, county, and local revenue, or county and local expenditures.
METHODOLOGY:
This Department of Health and Human Services (DHHS) states this bill would prevent families from enrolling in Healthy Kids Silver if they have access to employer based insurance. Presently in order to enroll, children must have been uninsured for six months, the family must be between 186% and 300% of the Federal Poverty Level (FPL), and the family must lack meaningful access to health insurance. While income is verified independently, self-declaration is accepted for no access to insurance. The Silver caseload as of September 30, 2009 was 7,762. The NH Healthy Kids Corporation reports that potentially as much as 20% of the rolling caseload may have access to employer based insurance, though at a much higher cost. This includes families with access at the time of enrollment or coverage that becomes available while the family is already utilizing Healthy Kids Silver. For the purposes of this fiscal note, the number of impacted members is estimated at 1,552 (20% x 7,762). The per member per month (PMPM) cost for Health Kids Silver in FY 2011 is $175. As a result, the Department estimates this bill would decrease total state expenditures by $3,259,200 annually (1,552 members X $175 PMPM X 12 months). Of this amount, 35% or $1,140,720 would be State general funds and 65% or $2,118,480 would be Federal Title XXI funds. The Department states application processing would likely take on added complexity under this bill as DHHS would need to verify that an employer does not offer family coverage unlike the current model that relies upon self-declaration.
