STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT requiring new construction and renovations of commercial buildings over 4,000 square feet to follow the Leadership in Energy and Environmental Design (LEED) guidelines relative to volatile organic compounds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Volatile Organic Compounds in New and Renovated Commercial Construction. Amend RSA 155-A by inserting after section 12 the following new section:

155-A:13 Volatile Organic Compounds; LEED Guidelines. In all new construction of and renovation of commercial buildings over 4,000 square feet and open to the public, contractors shall follow the Leadership in Energy and Environmental Design (LEED) guidelines as promulgated by the United States Green Building Council regarding volatile organic compound limits.

2 New Hampshire Building Code; LEED Guidelines. Amend RSA 155-A:1, IV to read as follows:

IV. “New Hampshire building code” or “state building code” means the adoption by reference of the International Building Code 2006, the International Plumbing Code 2006, the International Mechanical Code 2006, the International Energy Conservation Code 2006, and the International Residential Code 2006, as published by the International Code Council, [and] the National Electric Code 2008, and the volatile organic compounds guidelines in the Leadership in Energy and Environmental Design (LEED) guidelines as provided in RSA 155-A:13. The provisions of any other national code or model code referred to within a code listed in this definition shall not be included in the state building code unless specifically included in the codes listed in this definition.

3 Effective Date. This act shall take effect January 1, 2011.
