STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT establishing the legislative committee on the maintenance of state-owned dams.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Committee Established. Amend RSA 482 by inserting after section 93 the following new section:

482:94 Legislative Committee on the Maintenance of State-Owned Dams.

I. There is established a committee to review the maintenance of state-owned dams.

II. The members of the committee shall be as follows:

(a) Three members of the house of representatives, including one member of the public works and highways committee, one member of the ways and means committee, and one member of the resources, recreation and development committee, appointed by the speaker of the house of representatives, one of whom shall be designated by the speaker as chairman of the committee.

(b) Three members of the senate, appointed by the president of the senate.

(c) Members shall be appointed for their term of office, provided that all members shall be eligible for reappointment so long as they are qualified under the provisions of this paragraph.

III. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

IV. At least annually, the committee shall review the fiscal condition of the dam maintenance fund and associated regional dam trust funds for Winnipesaukee, Connecticut-Coos, Mascoma, Piscataquog, Sugar, Squam, and Newfound Lakes, and make recommendations for sustainability of the funds, including consideration of the decommissioning, breach, sale, rental, or other action related to specific dams, and consideration of other revenue sources to fund proper maintenance.

V. The members of the committee shall elect a secretary from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. Four members of the committee shall constitute a quorum.

VI. The committee shall report its findings and any recommendations for proposed legislation annually to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1.

2 Effective Date. This act shall take effect 60 days after its passage.
