AN ACT requiring funds for the purchase of modular or manufactured housing to be held in escrow until an occupancy permit is issued and relative to the development of a manufactured housing buyer’s guide.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT requiring funds for the purchase of modular or manufactured housing to be held in escrow until an occupancy permit is issued and relative to the development of a manufactured housing buyer’s guide.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Purchase of Modular or Manufactured Housing; Certificate of Occupancy Required. Amend RSA 205-B by inserting after section 3 the following new section:

205-B:3-a Purchase of Modular or Manufactured Housing; Certificate of Occupancy Required.

I. Ten percent of the funds for the purchase of any new modular or manufactured housing shall be retained by the buyer or mortgage lender in an escrow account until a certificate of occupancy or its equivalent is issued by the building inspector or local enforcement authority and provided to the buyer.

II. This section shall apply to the new construction of a residential modular building, as defined in RSA 205-C:1, XI, or manufactured housing, as defined in RSA 205-D:1, XI.

2 New Section; Manufactured Housing Installation Standards; Manufactured Housing Buyer’s Guide. Amend RSA 205-D to insert after section 20 the following new section:

205-D:21 Manufactured Housing Buyer’s Guide. The department shall adopt, under RSA 541-A, a manufactured housing buyer’s guide or similar document which shall describe the areas of responsibility of a manufacturer, dealer, and installer of manufactured housing, the enforcement authority of the department of safety and the installation standards board, and the consumer remedies available this chapter. The dealer or retailer of the property shall provide the manual to the buyer at the time of closing.

3 Effective Date. This act shall take effect January 1, 2011.
