ANALYSIS

This bill clarifies a restriction on the release of motor vehicle records information and prohibits the retention of identification documents used to obtain drivers’ licenses and nondrivers’ identification cards.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to motor vehicle records.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Motor Vehicle Records. Amend RSA 260:14, III to read as follows:

III. Motor vehicle records may be made available pursuant to a court order or in response to a request from a state, a political subdivision of a state, the federal government, or a law enforcement agency for use in official business. The request shall be on a case-by-case basis. Except as required by court order, requests made under this paragraph shall be limited to a named individual’s motor vehicle records. Any records received pursuant to this paragraph shall not be further transferred or otherwise made available to any other person or listed entity not authorized under this paragraph.

2 New Paragraph; Identification Cards. Amend RSA 260:21 by inserting after paragraph II the following new paragraph:

II-a. The department shall not copy any forms of proof of name, age, and residence provided under subparagraphs II(a)-(c) or retain any copies of such submitted by an applicant.

3 Identification. Amend the introductory paragraph of RSA 263:5-d to read as follows:

263:5-d Identification. The department may require reasonable identification from any applicant for a driver's license. The department shall not copy any forms of identification provided or retain any copies of an identification submitted by an applicant. Any person applying for a driver's license may present proof of identity in a form satisfactory to the department, provided that any of the following shall satisfy an identification requirement established pursuant to this section:

4 Effective Date. This act shall take effect 60 days after its passage.
