STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT changing the effective date of the expiration of the motor vehicle registration surcharge.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Highway and Bridge Betterment Account. Amend 2009, 144:246 to read as follows:

144:246 Highway and Bridge Betterment Account. From the motor vehicle registration fees and surcharges collected under RSA 261:141 as amended by this act, the department of safety shall dedicate $2,000,000 for the fiscal year ending June 30, 2010 [and $15,000,000 for the fiscal year ending June 30, 2011] to the highway and bridge betterment account established in RSA 235:23-a.

2 Motor Vehicle Registration Fees; Elimination of Surcharge and Increases; Effective Date. Amend 2009, 144:301, IX to read as follows:

IX. Sections 247 and 248 of this act shall take effect July 1, [2011] 2010.

3 Effective Date. This act shall take effect July 1, 2010.

HB 1588-FN - FISCAL NOTE

AN ACT changing the effective date of the expiration of the motor vehicle registration surcharge.

FISCAL IMPACT:

      The Department of Transportation and the Department of Safety state this bill will decrease state highway fund revenue by $29,700,000 and state restricted revenue and expenditures by $15,000,000 in FY 2011 and decrease state highway fund expenditure and local revenue by $5,364,000 in FY 2012. There will be no fiscal impact on county revenue or on county and local expenditures.

METHODOLOGY:

    The Department of Transportation and the Department of Safety state this bill moves the effective date of the elimination of the motor vehicle registration fee surcharge back one year to July 1, 2010. The Departments state this proposed change of the effective date eliminates the second year of surcharge revenue, which was estimated at $29,700,000 to the highway fund and $15,000,000 to the restricted betterment program and would total $44,700,000 in FY 2011. The Departments state the bill would also repeal this $15,000,000 revenue credit to the betterment program, which was to come from the surcharge revenue and will also mean a reduction in program expenditures by that same amount. The Departments also state this decline in the highway fund revenue would lead to a $5,364,000 decrease in highway fund expenditures and local revenue, as the block grant local aid program is an expenditure of highway funds and is calculated based on 12% of certain highway fund revenue sources (12% x $44,700,000).
