ANALYSIS

This bill establishes requirements for disclosure of electric service energy sources and environmental characteristics to customers by providers of electricity.

This bill was requested by the committee to study the standards and procedures by which certain information should be provided to electrical service customers, established in 2009, 94 (SB 97).

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to disclosure of electric service energy sources and environmental characteristics.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Disclosure of Electric Service Energy Sources and Environmental Characteristics. Amend RSA 378 by inserting after section 48 the following new subdivision:

Disclosure of Electric Service Energy Sources and Environmental Characteristics

378:49 Disclosure of Electric Service Energy Sources and Environmental Characteristics.

I. The public utilities commission shall, after notice and hearing, by order or rule, approve a standard format for providers of electricity to use in providing information to their customers regarding the energy sources and environmental characteristics of their electric service. Such information shall include but not be limited to:

(a) Energy sources by fuel type and their respective contributions to the total energy mix, by percentage;

(b) The environmental characteristics of the energy mix by fuel type, including but not limited to air pollutant emission rates; and

(c) A comparison with data regarding the average fuel mix of the region available from the Independent System Operator of New England.

II. Each provider of electricity, as defined in RSA 362-F:2, XIV, shall:

(a) Provide and make easily accessible on the provider’s Internet site the information for each electric service that it sells in the state;

(b) Update such information at least annually; and

(c) Provide such information to electric customers at least annually in conjunction with mailed or online billing, or other mailed or online communication to customers, using the adopted standard format. Appropriate access to more detailed relevant information shall also be included.

2 Effective Date. This act shall take effect 90 days after its passage.
