AN ACT requiring the suspension of boating privileges for refusing a blood alcohol test.

This bill requires the suspension of boating privileges if a person refuses to submit to physical tests or a test of blood, urine, or breath when under arrest for a violation of motor vehicle or OHRV laws.
This bill was requested by the department of safety.

In the Year of Our Lord Two Thousand Ten
AN ACT requiring the suspension of boating privileges for refusing a blood alcohol test.
Be it Enacted by the Senate and House of Representatives in General Court convened:
107:1 Refusal of Consent; Boating Privileges. Amend RSA 265-A:14, V to read as follows:
V. If a person’s license or privilege to drive is suspended under paragraph I or IV, the person’s privilege to operate a boat on the waters of the state shall also be suspended for the same period of time.
107:2 Effective Date. This act shall take effect July 1, 2011.
