STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the expiration of large groundwater withdrawal permits.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Expiration of Large Groundwater Withdrawal Permits. Amend RSA 485-C by inserting after section 21 the following new section:

485-C:21-a Expiration of Large Groundwater Withdrawal Permits.

I. Notwithstanding any other law to the contrary, if and when any required local building permit for a large groundwater withdrawal activity expires or becomes null and void, or both, the large groundwater withdrawal permit issued by the department shall expire immediately.

II. If such building permit is later reinstated or reissued to the same applicant, the large groundwater withdrawal permit may be reinstated by the department. No extension or modification of terms or conditions shall be made to the original permit. Any reinstated permit shall be in compliance with RSA 485-C:21.

2 Effective Date. This act shall take effect 30 days after its passage.
