AN ACT relative to grounds for revocation of a school bus driver’s certificate and relative to interference with traffic signaling devices.

AMENDED ANALYSIS

This bill establishes grounds for revocation of a school bus driver’s certificate.

This bill removes the requirement of the commissioner of the department of safety to compile and maintain a list of devices that are prohibited because they may interfere with traffic signaling devices.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to grounds for revocation of a school bus driver’s certificate and relative to interference with traffic signaling devices.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Positive Tests for Illegal Drugs. Amend RSA 263 by inserting after section 29-a the following new section:

263:29-b Positive Tests for Illegal Drugs. A holder of a school bus driver’s certificate who tests positive on a random or scheduled drug test for the presence of any illegal controlled drug in his or her system shall have his or her school bus driver’s certificate revoked by the director for a minimum of 2 years.

2 Traffic Signals; Interference with Devices. Amend RSA 265:15, II(a) to read as follows:

(a) No person shall use or attempt to use any device designed or intended to change, disrupt, or interfere with the operation of a traffic signal. [The commissioner of the department of safety shall compile and maintain a list of devices that are prohibited under this paragraph.]

3 Effective Date. This act shall take effect upon its passage.
