AN ACT relative to the state minimum hourly wage applicable to tipped restaurant employees.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the state minimum hourly wage applicable to tipped restaurant employees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Tipped Employees. Amend RSA 279:21 by inserting after paragraph III the following new paragraph:

III-a. Tipped employees of a restaurant shall include employees who serve meals prepared in a restaurant by delivering that food to a table in the restaurant or by delivery to the customer’s home, office, or other location.

2 Effective Date. This act shall take effect 60 days after its passage.
