AN ACT relative to the use of mail-order pharmacies for prescription drug benefits under accident and health insurance policies and plans.

This bill requires that insurers providing prescription drug benefits under accident and health insurance policies and plans allow the use of a pharmacy that is not a mail-order pharmacy.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the use of mail-order pharmacies for prescription drug benefits under accident and health insurance policies and plans.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Standards for Accident and Health Insurance; Prescription Drug Benefits; Mail-Order Pharmacies. Amend RSA 415-A by inserting after section 5-a the following new section:

415-A:5-b Prescription Drug Benefits; Mail-Order Pharmacies.

I. Consistent with a patient’s right to choose a pharmacy, all insurers that provide prescription drug benefits shall include in such prescription drug benefits the right of the insured and prospective enrollee to use a pharmacy that is not a mail-order pharmacy.

II. Insurers may offer to insureds and prospective enrollees the option of using a mail-order pharmacy, provided:

(a) Insureds and prospective enrollees need not take any action of any type to maintain the right to use a pharmacy that is not a mail-order pharmacy; and

(b) Such option does not interfere with the right to use a pharmacy that is not a mail-order pharmacy.

III. In this section:

(a) “Pharmacy” means pharmacy as defined in RSA 318:1, XI.

(b) “Mail-order pharmacy” means mail-order pharmacy as defined in RSA 318:1, VII-b.

2 Effective Date. This act shall take effect 60 days after its passage.
