AN ACT relative to the lapse of certain legislative and judicial branch appropriations, budget reductions for the department of health and human services, voluntary furloughs for judges, and transfers of federal funds.

AMENDED ANALYSIS

This bill:

I. Lapses certain sums appropriated to the legislative branch and the judicial branch to the general fund on or before June 30, 2011 pursuant to required operating budget adjustments.

II. Consolidates the amount to be reduced by the department of health and human services, as required under HB 1-A of the 2009 legislative session, for the biennium instead of for each fiscal year.

III. Clarifies the effect of the judicial branch furlough plan on judges who take unpaid furlough time.

IV. Allows for certain departmental budget transfers of federal funds.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to the lapse of certain legislative and judicial branch appropriations, budget reductions for the department of health and human services, voluntary furloughs for judges, and transfers of federal funds.

Be it Enacted by the Senate and House of Representatives in General Court convened:

4:1 Legislative Branch; Operating Budget Savings; Lapse. Pursuant to required adjustments to the legislative branch budget, and notwithstanding the designation in the 2010-2011 operating budget that legislative appropriations are nonlapsing, the legislative branch shall lapse to the general fund on or before June 30, 2011 the sum of $847,000.

4:2 Judicial Branch; Operating Budget Savings; Lapse. Pursuant to required adjustments to the judicial branch budget, the judicial branch shall lapse to the general fund on or before June 30, 2011 the sum of $3,100,000.

4:3 Department of Health and Human Services; Reduction in Appropriation. Amend 2009, 143:9 to read as follows:

143:9 Department of Health and Human Services; Reduction in Appropriation. The department of health and human services is hereby directed to reduce state general fund appropriations from any line by [$7,359,331 for the fiscal year ending June 30, 2010, and $12,199,900 for the fiscal year] $19,559,231 for the biennium ending June 30, 2011. Any direct services to New Hampshire citizens shall be excluded from these reductions unless expressly approved by the fiscal committee of the general court and the governor and council. The department shall provide a quarterly report of reductions made under this section to the fiscal committee of the general court and the governor and council.

4:4 Judicial Branch; Voluntary Furloughs for Judges. Judges may volunteer to take unpaid furlough time on or before June 2, 2011, in accordance with the judicial branch furlough plan. Judges who volunteer to take furlough time shall not be deemed by that act to be holding office for other than the full or part-time service to which they were appointed, and the taking of voluntary furlough time shall not be deemed a reduction in salary or service for purposes of the calculation of any retirement or other job-related benefits.

4:5 Department Budgets; Transfers of Federal Funds. In order to maximize the use of federal grant funds and to avoid lapsing such funds where changes in the state or federal accounting systems, changes in federal grant guidelines, or overestimation or underestimation of funds required in various class codes due to program needs or requirements, have occurred subsequent to the passage of the budget, notwithstanding any other provisions of law to the contrary, every department as defined in RSA 9:1 is hereby authorized, for the biennium ending June 30, 2011, subject to the prior approval of the fiscal committee and the approval of governor and council, to transfer funds in or out of any class code and to create new class codes within federally funded areas of the department’s operating budget so long as such transfers do not result in an over expenditure of the grant.

4:6 Effective Date.

I. Sections 1 and 2 of this act shall take effect 60 days after its passage.

II. The remainder of this act shall take effect upon its passage.
