AN ACT relative to retirement system service credit for employment as a full-time police officer with the university system of New Hampshire.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to retirement system service credit for employment as a full-time police officer with the university system of New Hampshire.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Retirement System; Credit for Certain Prior Group II Service. Amend RSA 100-A by inserting after section 4-c the following new section:

100-A:4-d Credit for Certain Prior Service; Group II Permanent Police Members. Upon becoming employed by a retirement system employer, credit for prior service as a regular full-time police officer for the university system of New Hampshire, in a job which requires full certification as a police officer in this state, may be purchased as group II permanent policeman service. Upon certification by the New Hampshire retirement system of eligibility for prior service credit, and upon payment by the member of the cost of such credit, and with the approval of the board of trustees, the member shall receive credit for such out-of-state service. In no case shall service purchased as creditable service in the New Hampshire retirement system under the provisions of this section be deemed to be creditable service for the purposes of eligibility for medical benefits after retirement under the provisions of RSA 100-A:52 through 100-A:55 or RSA 21-I:26 through 21-I:36.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 470 FISCAL NOTE

AN ACT relative to retirement system service credit for employment as a full-time police officer with the university system of New Hampshire.

FISCAL IMPACT:

      The New Hampshire Retirement System states this bill would increase state, county, and local expenditures by an indeterminable amount in FY 2012 and each year thereafter. There is no fiscal impact on state, county, and local revenue.

METHODOLOGY:

    The New Hampshire Retirement System states this bill would permit any individual who has ever served as a full-time regular police officer for the University System of New Hampshire to purchase service credit in the Retirement System if that individual becomes employed by another employer participating in the System. The System states it has no means to estimate the number of former University System police officers who are now employed by participating System members or the number of years of creditable service eligible for purchase. The System’s actuary also states the bill would likely result in those former University police officers buying back years of service credit at an amount less than the full actuarial value of the service credit. The System states any gap between the full actuarial value of the service credit and the amounts paid by the former University police officers would be made up in the form of higher employer contribution rates beginning in FY 2012, as the rates for FY 2010 and 2011 have already been set.
