AN ACT relative to administration support of certain professional regulatory boards by the department of health and human services.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Ten

AN ACT relative to administration support of certain professional regulatory boards by the department of health and human services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Department of Health And Human services; Administrative Support; Regulatory Boards. Amend RSA 126-A by inserting after section 10 the following new section:

126-A:10-a Administrative Support; Professional Regulatory Boards.

I. For any professional regulatory boards and advisory councils or committees which are under the supervision and control of the department, and for any boards or councils which are administratively attached under RSA 21-G:10 to the department and are designated as subject to the provisions of this section, the commissioner may consolidate the following functions in order to provide efficiency and coordination of the administrative support of professional regulatory boards:

(a) Location of office space and meeting space.

(b) Provision of staff for administrative support functions.

(c) Mailing and processing services.

(d) Automated licensing and regulatory compliance system administration and support.

(e) Procurement of supplies.

II. Department costs for the services provided under this section shall be reimbursed by the boards and councils with such costs allocated equitably amongst the respective boards and councils, as determined by the commissioner.

III. Nothing in this section shall affect the authority of professional regulatory boards and councils administratively attached to the department from exercising the powers, duties, functions, and responsibilities granted by statute.

2 Hearing Care Providers. Amend RSA 137-F:3, VIII to read as follows:

VIII. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

3 Nursing Home Administrators. Amend RSA 151-A:3, VI to read as follows:

VI. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

4 Podiatry. Amend RSA 315:1 to read as follows:

315:1-a Administratively Attached. The board of podiatry shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

5 Chiropractic Examiners. Amend RSA 316-A:2, IV to read as follows:

IV. The board of chiropractic examiners shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

6 Dental Examiners. Amend RSA 317-A:2, IV to read as follows:

IV. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

7 Embalmers and Funeral Directors. Amend RSA 325:2, IV to read as follows:

IV. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

8 Midwifery Council. Amend RSA 326-D:3, III to read as follows:

III. The council shall be administratively attached, under RSA 21-G:10, to the department of health and human services. In addition, the council shall be subject to the provisions of RSA 126-A:10-a.

9 Dietitians. Amend RSA 326-H:7, VI to read as follows:

VI. The [commissioner of the department of health and human services shall provide administrative services to the board. All administrative services shall be a cost to the board and shall be reimbursed by fees collected by the board through rules adopted under RSA 326-H:10.] board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

10 Optometry. Amend RSA 327:2, IV to read as follows:

IV. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

11 Naturopathic Board of Examiners. Amend RSA 328-E:7, VII to read as follows:

VII. The board shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

12 Allied Health Professionals. Amend RSA 328-F:3, III to read as follows:

III. There shall be an office of licensed allied health professionals established in Concord. It shall be an administratively attached agency, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

13 Acupuncture. Amend RSA 328-G:4 to read as follows:

328-G:4 Administrative Attachment. The board of acupuncture shall be an administratively attached agency, under RSA 21-G:10, to the office of the commissioner of the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

14 Mental Health Practice. Amend RSA 330-A:5 to read as follows:

330-A:5 Administrative Attachment. The board shall be administratively attached under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

15 Alcohol and Other Drug Use Professionals. Amend RSA 330-C:4 to read as follows:

330-C:4 Administrative Attachment. The board shall be administratively attached, under RSA 21-G:10, to the department of health and human services. In addition, the board shall be subject to the provisions of RSA 126-A:10-a.

16 Effective Date. This act shall take effect July 1, 2010.

SB 499-FN - FISCAL NOTE

AN ACT relative to administration support of certain professional regulatory boards by the department of health and human services.

FISCAL IMPACT:

      The Department of Health and Human Services states this bill may have an indeterminable fiscal impact on state expenditures in FY 2011 and each year thereafter. This bill will have no fiscal impact on state, county, and local revenue and county and local expenditures.

METHODOLOGY:

    The Department of Health and Human Services (DHHS) states this bill allows the commissioner of DHHS to consolidate certain functions in order to provide efficiency and coordination of the administrative support of professional regulatory boards. The functions include location of office space, coordination of administrative support staff, automated licensing, and procurement of supplies. The Department states the nature and content of a plan to coordinate the administrative functions of the various boards will require a review of the resources currently available, dialog with the various boards to understand their needs, and identification of options available for the future. Without this review and stakeholder input, estimating additional costs or costs savings is impossible. Since the most significant change in cost will likely result from co-locating many of the board administrative functions which would require lease or renovation of office space, it is unlikely that there will be any significant change in cost at least until SFY12.
