AN ACT relative to decisions and actions of the joint committee on legislative facilities.

AMENDED ANALYSIS

This bill allows for decisions and actions of the joint committee on legislative facilities to be stayed pending a concurrent resolution to reverse or amend the decision or action. The bill also clarifies the powers of the committee to establish policies for the operation of legislative facilities.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to decisions and actions of the joint committee on legislative facilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Joint Committee on Legislative Facilities; Powers and Duties. Amend RSA 17-E:5-a, VIII to read as follows:

VIII. To establish policies regarding the [use] operation of the facilities under control of the legislature in the state house, the legislative office building, the Upham Walker house, parking garages and lots, and any future facility that may come under legislative management.

2 New Section; Joint Committee on Legislative Facilities; Stay of Committee Action. Amend RSA 17-E by inserting after section 5-a the following new section:

17-E:5-b Stay of Committee Action. A decision or action of the committee pursuant to RSA 17-E:5-a shall be effective unless the chairperson of the committee is presented a notice by a member of the general court indicating the intent to petition for reversal or amendment of the decision or action. The stay of the committee action shall be effective for 14 calendar days upon the filing of the notice. During the 14-day period, the petition shall be signed by at least 25 percent of the members of the body originating a petition for stay, otherwise the stay shall be removed. If the required signatures are achieved, the stay shall continue and the member shall cause to be introduced a concurrent resolution reversing or amending the decision or action of the committee. A concurrent resolution under this section may be introduced at any time during the legislative session. It shall be subject to the same rules as any other concurrent resolution introduced at the beginning of the legislative session. The decision or action of the committee shall be stayed pending the final disposition of the concurrent resolution addressing the matter.

3 Effective Date. This act shall take effect 60 days after its passage.
