AN ACT relative to procedures for property revaluations.

ANALYSIS

This bill requires that procedures for updating assessments in a property revaluation for property tax purposes shall not include statistical updates based on sales data, but shall be based on visual inspection and practice of measure and list.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to procedures for property revaluations.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Department of Revenue Administration; Appraisals of Property for Ad Valorem Tax Purposes. Amend RSA 21-J:11, III(a) to read as follows:

(a) Contract or agreement provisions for a full revaluation, a cyclical revaluation, or a partial revaluation[, or a statistical update] where appraisal is by measure and listing, provided that the rules adopted shall not permit the maintenance of assessments by statistical updates; and

2 New Subparagraph; Assessing Standards Board; Guidelines for Revaluations. Amend RSA 21-J:14-b, I by inserting after subparagraph (e) the following new subparagraph:

(f) The prohibition of the use of statistical updates in revaluations in lieu of visual inspection and measure and list.

3 New Paragraph; Revised Inventory. Amend RSA 75:8 by inserting after paragraph II the following new paragraph:

III. No adjustment under this section shall be made solely based on sales data compiled for statistical updates.

4 Effective Date. This act shall take effect 60 days after its passage.
