AN ACT making an appropriation to the milk producers emergency relief fund.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Fiscal Year 2012; Appropriation. The sum of $2,500,000 is hereby appropriated to the department of agriculture, markets, and food for deposit in the milk producers emergency relief fund established in RSA 184:107 for the fiscal year ending June 30, 2012. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
2 Fiscal Year 2013; Appropriation. The sum of $2,500,000 is hereby appropriated to the department of agriculture, markets, and food for deposit in the milk producers emergency relief fund established in RSA 184:107 for the fiscal year ending June 30, 2013. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
3 Effective Date. This act shall take effect July 1, 2011.

HB 417-FN-A - FISCAL NOTE
AN ACT making an appropriation to the milk producers emergency relief fund.
FISCAL IMPACT:
The Department of Agriculture, Markets, and Food states this bill will increase state general fund expenditures by $2,500,000 in FY 2012 and 2013. There will be no fiscal impact on state revenues or county and local revenues or expenditures.
This bill appropriates $2,500,000 in FY 2012 and $2,500,000 in FY 2013 from the state general fund to the milk producers emergency relief fund for the purposes of this act.
METHODOLOGY:
The Department of Agriculture, Markets, and Food states this bill will make general fund appropriations to the milk producers emergency relief fund in FY 2012 and FY 2013 of $2,500,000 per year for the purpose of reimbursing New Hampshire producers of raw milk when the base price of milk falls below the target price set forth by the Milk Producers Emergency Relief Fund Board. Per RSA 184:107, each eligible participating milk producer in the state shall be eligible to receive an amount of money equal to the month's production in hundredweight (CWT) multiplied by the difference between the target price and the base price for the month. The Department estimates a total of 265,000 CWT of milk production per year, a base rate of $16.11/CWT, and the target price is currently set at $25.99/CWT, a difference of $9.88. The Department estimates a total of $2,618,200 per year (265,000 X $9.88) in eligible reimbursements from the fund in FY 2012 and FY 2013. The Department states if it is unable to make full payment to all producers, it will prorate payments to each producer to the extent funds are available, as required by statute.
