STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT creating a database of New Hampshire grown genetically modified crops.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Genetically Modified Organisms. Amend RSA 433 by inserting after section 36 the following new subdivision:

Genetically Modified Organisms

433:37 Genetically Modified Organisms. “Genetically modified organism” or “GMO” means organisms that are a result of a laboratory process of taking genes from one species and inserting them into another in an attempt to obtain a desired trait or characteristic. This science of allowing DNA from one species to be injected into another species in a laboratory, creates combinations of plant, animal, bacteria and viral genes with traits that do not occur in nature or through traditional crossbreeding methods.

433:38 Genetically Modified Organism Database.

I. Each growing season, any person who plants crops using genetically modified organisms, whether grown from seed or purchased from a retailer, shall submit the following information to the commissioner of the department of agriculture, markets and food:

(a) The address at which such crops are grown;

(b) The name of the crop or crops being grown;

(c) The name of the seed company holding the patent to such crops;

(d) The number of acres the crop is planted on; and

(e) The owner of the property on which the crops are grown or, if the property is rented, the name of the grower of the crops.

II. The information required in paragraph I shall be submitted to the commissioner at the same time it is required to be submitted to the manufacturer of the GMO seeds being used.

III. The commissioner shall collect the information set forth above and compile a database of such information. Such database shall be available to the public on the internet website of the department of agriculture, markets and food.

2 Effective Date. This act shall take effect July 1, 2011.
