AN ACT relative to issuance of individual health insurance policies by health carriers.

This bill prohibits health carriers from issuing a new individual health insurance policy pursuant to RSA 420-G if the individual is eligible for certain other group health coverage.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to issuance of individual health insurance policies by health carriers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Health Coverage. Amend RSA 420-G:6 by inserting after paragraph II-a the following new paragraph:

II-b. Health carriers shall not issue a new individual health insurance policy to an individual who is eligible for and who is offered major medical group health coverage that meets all applicable state and federal requirements, including the standards for minimum essential benefits established under the Patient Protection and Affordable Care Act of 2009, Public Law 111-148, as amended by the Health Care and Education Reconciliation Act of 2010, Public Law 111-152.

2 Effective Date. This act shall take effect 60 days after its passage.
