STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

A RESOLUTION urging our federal senators to vote against the Law of the Sea Convention.

Whereas, Article 1, Section 1 of the Constitution for the United States of America delegates all legislative authority of the government of United States of America to the Congress of the United States; and

Whereas, Article 2, of the Constitution for the United States of America delegates no legislative authority to the President of the United States of America; and

Whereas, the government of the United States of America currently claims a continental shelf extending 200 miles from the coastal territories of its member States; and

Whereas, the Law of the Sea Convention also known as the Law of the Treaty adds no sovereign jurisdictions to the United States of America; and

Whereas, the Law of the Sea Convention will empower the United Nations to levy fees upon a Corporation formed under the jurisdiction of the United States of America or its member States to mine the sea bed under the territorial seas and continental shelf; and

Whereas, the Law of the Sea Convention would give jurisdiction over all non-territorial waters, the sea bed beneath them and the air above them, to the United Nations; and

Whereas, the State of New Hampshire is a member of the United States of America with coastal waters; and

Whereas, the State of New Hampshire is represented in the United States House of Representatives and the United States Senate in the Congress of the United States by Senator Shaheen and Senator Ayotte; now, therefore, be it

Resolved by the House of Representatives, the Senate concurring:

That the general court of the state of New Hampshire urges Senator Shaheen and Senator Ayotte representing New Hampshire in the United States Senate in the Congress of the United States to vote against ratification of the Law of the Sea Convention; and

That the general court of the state of New Hampshire does not support any executive order creating new treaties or agreements among nations or with the United Nations without the affirmative vote of 2/3 of the United States Senate; and

That the house clerk transmit copies of this resolution to Senator Shaheen and Senator Ayotte.
