AN ACT relative to the size limitations on OHRVs, and the operation of OHRVs on state-owned trails.

This bill increases the size limitations for OHRVs operating on state-owned trails and excepts certain trails in Jericho Mountain state park. The bill also adds a definition of utility terrain vehicle.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to the size limitations on OHRVs, and the operation of OHRVs on state-owned trails.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Evaluation Process; ATV and Trail Bike Operation on State Lands. Amend RSA 215-A:43, IV to read as follows:

IV. No person shall operate an OHRV wider than [50] 65 inches or over [1000] 1600 pounds dry weight on any state-owned trails, except on specifically designated trails within Jericho Mountain state park. An OHRV wider than 50 inches and over 1000 pounds shall be permitted only on those trails designated by the bureau.

2 Definition Added; Utility Terrain Vehicle. Amend RSA 215-A:1 by inserting after paragraph XXII the following new paragraph:

XXIII. “Utility terrain vehicle” means any motor-driven vehicle which is designed or adapted for travel over surfaces other than maintained roads with one or more tires designed to hold not more than 10 pounds per square inch of air pressure, having capacity for passengers or other payloads, not in excess of 1,600 pounds net vehicle weight, and not to exceed 65 inches in width. For purposes of this chapter, all vehicles within this definition shall be classified as off highway recreational vehicles.

3 Effective Date. This act shall take effect 60 days after its passage.
