AN ACT extending the state board of education’s authority to approve chartered public schools and relative to the funding of chartered public schools approved by a school district.

This bill:

I. Repeals the 10-year pilot program for state board of education approval of chartered public schools and gives the state board of education permanent authority to approve chartered public schools.

II. Requires that the state pay tuition for each pupil attending a chartered public school located in this state but outside of the pupil’s resident school district directly to such chartered public school.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT extending the state board of education’s authority to approve chartered public schools and relative to the funding of chartered public schools approved by a school district.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Chartered Public Schools; Pilot Program. Amend the section heading in RSA 194-B:3-a and RSA 194-B:3-a, I to read as follows:

194-B:3-a Chartered Public School Approval by State Board of Education[; Pilot Program].

I. [There is established a 10-year pilot program which authorizes the state board of education to grant charter status under this section. Beginning July 1, 2003, the state board of education shall be authorized to grant no more than 20 state chartered public school applications during the 10-year pilot program] The state board of education may grant charter status to applicants that meet the requirements of this chapter.

2 Chartered Public School; Funding. Amend RSA 194-B:11, I(a) to read as follows:

I.(a) There shall be no tuition charge for any pupil attending a charter conversion school located in that pupil's resident district. Funding limitations in this chapter shall not be applicable to charter conversion schools located in a pupil's resident district. For a chartered public school authorized by the school district, the pupil's resident district shall pay to such school an amount equal to not less than 80 percent of that district's average cost per pupil as determined by the department of education using the most recent available data as reported by the district to the department. For pupils who attend a chartered public school located outside of the pupil’s resident school district, the state shall pay tuition pursuant to RSA 198:40-a directly to such chartered public school for each pupil who is a resident of this state in attendance at such chartered public school.

3 Repeal. The following are repealed:

I. 2003; 273:7, I, relative to repeal of the state board of education chartered public school pilot program.

II. 2003; 273:9, I, relative to the effective date of the repeal of the state board of education chartered public school pilot program.

4 Effective Date. This act shall take effect 60 days after its passage.

SB 82 FISCAL NOTE

AN ACT extending the state board of education’s authority to approve chartered public schools and relative to the funding of chartered public schools approved by a school district.

FISCAL IMPACT:

    The Department of Education states this bill will have no fiscal impact on state, county, and local revenue and expenditures in FY 2011 and each year thereafter.

METHODOLOGY:

    The Department of Education states this bill repeals the 10-year pilot program for the state board of education approval of chartered public schools and gives the state board of education permanent authority to approve such schools. The bill also requires the state pay tuition for each pupil attending a chartered public school located in New Hampshire but outside of the pupil’s resident school district directly to such school. The Department states this proposal will have no fiscal impact on state, county, and local revenue and expenditures.
