AN ACT relative to the dental hygienists committee of the dental board.

ANALYSIS

This bill changes the appointment procedure for the dental hygienists committee of the dental board and provides that rules for dental hygienists proposed by the dental hygienists committee shall be adopted unless they are outside of their jurisdiction, impose an undue financial burden, or are not supported by the record.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the dental hygienists committee of the dental board.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Dental Hygienists Committee; Appointment; Rules. RSA 317-A:2-a is repealed and reenacted to read as follows:

317-A:2-a Dental Hygienists Committee.

I.(a) A dental hygienists committee is established, which shall consist of 4 dental hygienists and one dentist. One of the dental hygienist members and the dentist member shall be current members of the board of dental examiners, selected by a majority of the board to serve one-year terms.

(b) The dentist member of the committee shall have supervised and worked in collaboration with a dental hygienist for a period of at least 3 years immediately preceding appointment to the committee.

(c) The additional dental hygienists committee members shall be appointed by the governor with the approval of the council, to serve terms of 3 years, with initial terms staggered to provide for annual appointments.

(d) A majority of the committee, including 3 dental hygienists, shall constitute a quorum.

(e) The committee shall annually elect a chairperson from among its members. The initial chairperson shall be elected at the committee’s first meeting.

(f) The committee shall meet at the call of the chair, at least 4 times a year and at least once every 120 days.

II. The committee shall have the authority to develop and propose the administrative rules regarding the practice, regulation, discipline, education, examination, and licensure of dental hygienists, subject to paragraph III, and shall carry out additional duties as assigned by the board.

III. The administrative rules proposed by the committee shall be accepted by the board for adoption under RSA 317-A:12 and RSA 541-A, unless the board determines that a recommendation is outside of the jurisdiction of the committee as defined in paragraph II, would impose an undue financial burden on the board, or is not supported by the record. The proposed rules shall be on the first meeting agenda of the board of dental examiners following adoption of the proposed rules by the committee, or at a meeting of the board specifically called for the purpose of review and approval of rules proposed by the committee, whichever comes first.

IV. This section shall not be construed as affecting or changing the scope of practice of the profession of dental hygiene.

2 Applicability. Members of the dental hygienists committee serving on the effective date of this act may continue to serve for the remainder of their term. Vacancies and subsequent appointments shall comply with RSA 317-A:2-a as amended by this act.

3 Effective Date. This act shall take effect 60 days after its passage.
