HOUSE BILL 1228
AN ACT prohibiting the sale of grave markers and memorial markers by funeral directors.

This bill prohibits the owner or operator of a funeral establishment from operating a monument sales business on the same premises as the funeral establishment.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT prohibiting the sale of grave markers and memorial markers by funeral directors.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Funeral Establishments. Amend RSA 325 by inserting after section 44 the following new section:
325:44-a Separation; Funeral Establishments and Monument Sales. No funeral home, funeral establishment, or funeral director shall engage in the business of selling gravestones, headstones, or other monuments designed to mark the gravesite of any deceased person at the same location as such funeral home, funeral establishment, or funeral direction occurs.
2 New Paragraph; Rulemaking. Amend RSA 325:9 by inserting after paragraph XI the following new paragraph:
XII. Conditions for the operation of separate funeral direction and monument sales enterprises by one funeral director licensed under this chapter.
3 Effective Date. This act shall take effect January 1, 2013.
