AN ACT relative to exceptions for municipal regulation of hawkers and peddlers.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to exceptions for municipal regulation of hawkers and peddlers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Hawkers and Peddlers; Exceptions. Amend RSA 31 by inserting after section 102-b the following new section:

31:102-c Exceptions. The provisions of RSA 31:102-a shall not be construed to grant authority for ordinances or regulations which apply to the following:

I. Any person selling the product of his or her own labor or the labor of his or her family or the product of his or her own farm or the one the person tills.

II. Any person conducting sales of personal household goods on the person’s own property.

III. Any nonprofit organization, community chest, fund or foundation organized and operated exclusively for religious, charitable, scientific, literary, or educational purposes when no part of the entity's earnings benefit any private shareholder or individual.

IV. Any person conducting business in any industry or association trade show.

V. Any person who sells exclusively antiques, used goods, or vintage items.

2 Effective Date. This act shall take effect 60 days after its passage.
