AN ACT requiring refunds for returns of merchandise.

This bill requires proprietors of retail establishments to give refunds in the form of cash or credit for returned merchandise under certain circumstances.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT requiring refunds for returns of merchandise.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Chapter; Refunds Required for Returns of Merchandise. Amend RSA by inserting after chapter 358-S the following new chapter:

CHAPTER 358-T

REFUNDS FOR RETURNS OF MERCHANDISE

358-T:1 Refund Required. The proprietor of any retail establishment in this state shall give a refund for any item purchased at such establishment in the form of cash or credit on the credit or debit card originally used by the customer for the transaction, when;

I. The item was purchased with a credit card or cash or check, provided the check or debit has cleared the bank;

II. The item is returned with its sales slip or sales receipt;

III. The person returning the item wants a refund rather than a merchandise credit;

IV. The item is returned in the same condition as originally purchased, unless the merchandise is defective; and

V. The item is returned within 60 days of purchase.

2 Effective Date. This act shall take effect 60 days after its passage.
