STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT establishing non-unanimous juries.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Non-unanimous Juries; Civil Proceedings. Amend RSA 500-A by inserting after section 20 the following new section:
500-A:21 Non-unanimous Juries. In civil trials, 10 jurors may render a verdict for or against the defendant.
2 New Section; Non-unanimous Juries; Criminal Proceedings. Amend RSA 625 by inserting after section 11 the following new section:
625:12 Non-unanimous Juries. In criminal prosecutions, 11 jurors may render a verdict of guilty or not guilty, except for a verdict of guilty of capital murder which shall only be found by a unanimous verdict.
3 Effective Date. This act shall take effect January 1, 2013.
