STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to prior legislative approval for the expenditure of funds for low carbon fuel standards programs.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subdivision; Participation in Low Carbon Fuel Standards Programs. Amend RSA 21-O by inserting after section 22 the following new subdivision:

Participation in Low Carbon Fuel Standards Programs

21-0:23 Low Carbon Fuel Standards Programs; State Participation. Notwithstanding the provisions of RSA 21-0:1 through 21-0:22, the department of environmental services shall neither apply for nor expend any funds from any source, without prior legislative approval, for the purpose of involving the state of New Hampshire in planning, evaluating, implementing, or participating in any state, regional, or national low carbon fuel standards program, or any other similar program designed to address the carbon content of fuels by requiring reductions in greenhouse gas emissions in fuels used for transportation, industrial purposes, or home heating.

21-0:24 Applicability. Nothing in this subdivision shall be construed to affect or modify the provisions of RSA 125-J or RSA 125-0.

2 Effective Date. This act shall take effect upon its passage.
