AN ACT relative to guardianship of elderly persons.

ANALYSIS

This bill provides that if the commissioner of the department of health and human services seeks guardianship of an elderly person, liquidating the person’s assets shall not occur during the first 6 months of guardianship.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to guardianship of elderly persons.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Guardianship of Elderly Person. Amend RSA 161:52 to read as follows:

161-F:52 Guardianship.

I. If all other remedies are exhausted, the commissioner or [his] the commissioner’s authorized representative may seek to have a guardian or conservator appointed by the probate court, pursuant to RSA 464-A, for any adult who is in need of protective services.

II. If the commissioner seeks guardianship pursuant to this section, liquidation of the person’s assets shall not occur within the first 6 months of such guardianship.

2 Effective Date. This act shall take effect January 1, 2013
