AN ACT relative to fire code requirements for licensed foster homes.

ANALYSIS

This bill provides that a foster family home located in a multi-unit dwelling that complies with fire code requirements for multi-unit dwellings shall not be required to install additional fire warning devices.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to fire code requirements for licensed foster homes.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Foster Family Home; Compliance with Fire Code. Amend RSA 170-E:28, II to read as follows:

II. Either the state fire marshal or the local fire department shall review compliance of the foster family home with applicable state fire safety laws and local ordinances. In conducting the review, the state fire marshal or local fire department shall apply the appropriate single family or multi-unit dwelling provisions of the applicable code. Notwithstanding RSA 126-A:21 or any other law or local ordinance to the contrary, no foster family home applicant located in a multi-unit dwelling that meets the requirements for automatic fire warning devices in RSA 153:10-a, I shall be required to install additional fire warning devices in order to be licensed as a foster family home under this chapter.

2 Effective Date. This act shall take effect 60 days after its passage.
