AN ACT relative to petitions for reconsideration of court rulings in the judicial branch family division.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to petitions for reconsideration of court rulings in the judicial branch family division.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Judicial Branch Family Division; Petitions for Reconsideration. Amend RSA 490-D by inserting after section 15 the following new section:

490-D:16 Petitions for Reconsideration. No petition for reconsideration of a ruling made in a matter under the jurisdiction of the judicial branch family division shall be denied by the court:

I. Based solely upon the failure of the petitioner to disclose information at a prior hearing.

II. Because the court has found the petitioner to be in contempt of the ruling.

III. Based on insufficiency of submitted affidavits of fact.

2 Effective Date. This act shall take effect January 1, 2013.
