This bill eliminates the requirement that trucks exceeding 18,000 pounds gross vehicle weight be inspected semiannually. These vehicles would then be subject to annual inspections.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to inspections of trucks and buses.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Inspection of Trucks and Buses. Amend RSA 266:1, IX to read as follows:

IX. Notwithstanding any other provisions of this section to the contrary, [all trucks exceeding 18,000 pounds gross vehicle weight and] all school buses exceeding 10,000 pounds gross vehicle weight[, including buses owned or used by a religious organization or a nonprofit organization used exclusively as buses for the transportation of its members in connection with functions of the organization,] shall be inspected semiannually. The month for the first inspection shall be the month in which the birth date of the owner is observed, if the owner is a natural person; if the owner is other than a natural person, the first inspection shall be conducted during the month designated by the director as the registration month for such legal entity. In either case, the second inspection shall be 6 months later.

2 Effective Date. This act shall take effect January 1, 2013.

HB 1585-FN - FISCAL NOTE

AN ACT relative to inspections of trucks and buses.

FISCAL IMPACT:

      The Department of Safety states this bill will decrease state restricted revenues by $34,500 in FY 2013, and $69,000 in FY 2014 and each year thereafter, and will decrease state general fund revenue by $2,875 in FY 2013, and $5,750 in FY 2014 and each year thereafter. The Department of Safety also states this bill will decrease state highway fund expenditures and local revenue by $3,795 in FY 2014, and by $7,590 in FY 2015 and each year thereafter. There will be no fiscal impact on county revenue, or county and local expenditures.

METHODOLOGY:

    The Department of Safety states this bill repeals the current section of law that requires trucks exceeding 18,000 pounds of gross vehicle weight to be inspected semi-annually. If this repeal were to be enacted, the Department states these vehicles, of which it estimates there are roughly 23,000 in the state, would then be subject to the requirement that they be inspected annually, which the Department states would lead to a loss in revenue collected from inspection sticker sales, as each of these vehicles would be required to obtain 1 inspection sticker annually, instead of the 2 required currently. The Department collects $3.25 for each inspection sticker, with $2.75 deposited in the state highway fund, $0.25 deposited in the motor vehicle air pollution abatement fund, and $0.25 in general fund. The effective date of the bill is January 1, 2013, so the Department states the decline in revenue in FY 2013 would be for half of the year. The Department states this change from semi-annually required inspections to annually required inspections would represent a loss in state highway fund revenue of $31,625 (23,000 vehicles x $2.75 x 0.5 year) in FY 2013, and $63,250 (23,000 vehicles x $2.75 x 1 year) in FY 2014 and each year thereafter. The Department also states the bill would result in a loss to both the motor vehicle air pollution abatement fund, and the state general fund of $2,875 (23,000 vehicles x $0.25 x 0.5 year) apiece in FY 2013, and $5,750 (23,000 vehicles x $0.25 x 1 year) apiece in FY 2014 and each year thereafter. Due to the decline in state highway fund revenue, the Department also estimates state expenditures for local highway aid, pursuant to RSA 235:23 would decrease by $3,795 ($31,625 x 12%) in FY 2014, and by $7,590 ($63,250 x 12%) in FY 2015 and each year thereafter, with corresponding decreases in local revenue.
