STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the approval process to increase the load on a sewage disposal system.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Sewage Disposal Systems. Amend RSA 485-A:38, II-a(a) to read as follows:

(a) The lot is served by a sewage disposal system that received and was constructed in accordance with construction and operational approval from the department [within 20 years of the date of the issuance of a building permit for the proposed expansion, relocation, or replacement] the sewage disposal system is not in failure as defined under RSA 485-A:2, IV and no load has been added to the sewage disposal system since the issuance of the approval.

2 Effective Date. This act shall take effect 60 days after its passage.
