AN ACT relative to guaranteed issue for health insurance.

ANALYSIS

This bill declares that health carriers shall issue and renew health insurance coverage to individuals under 19 years of age and shall not impose a preexisting condition exclusion period for such individuals.

This bill is a request of the insurance department.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to guaranteed issue for health insurance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Health Insurance; Guaranteed Issue. Amend the introductory paragraph of RSA 420-G:6, I to read as follows:

Health carriers shall not establish rules of eligibility, including continued eligibility, for health coverage in relation to the following health status related factors of any employee or dependent or individual under 19 years of age:

2 Health Insurance; Guaranteed Issue. Amend RSA 420-G:6, III to read as follows:

III. Health carriers shall actively market, issue, and renew all of the health coverages they sell in the small employer market to all small employers and individuals under 19 years of age.

3 New Paragraph; Preexisting Conditions. Amend RSA 420-G:7 by inserting after paragraph II the following new paragraph:

II-a. No health carrier shall impose a preexisting condition exclusion period for health coverage issued to a person under 19 years of age.

4 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to guaranteed issue for health insurance.

FISCAL IMPACT:

    The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill as it is awaiting information from the Insurance Department. When completed, the fiscal note will be forwarded to the Senate Clerk's Office.
