AN ACT relative to field purchases and transfers of funds for the state park system and the bureau of trails, and the use of gifts and donations to the division of parks and recreation.

This bill:

I. Eliminates the deadline on field purchases and transfers of funds for the state park system and the bureau of trails.

II. Establishes a fund to collect gifts and donations to the state park system.

This bill is a request of the department of resources and economic development, division of parks and recreation.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to field purchases and transfers of funds for the state park system and the bureau of trails, and the use of gifts and donations to the division of parks and recreation.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 State Park System; Deadline for Field Purchases and Transfer of Funds Eliminated. Amend RSA 216-A:3-m to read as follows:

216-A:3-m Field Purchases and Transfer of Funds.

I. Notwithstanding RSA 21-I:17-a, I, the director of the division of parks and recreation may make purchases using field purchase orders for expenditures of up to $2,000 for the state park system and facilities [through June 30, 2012].

II. The commissioner of the department of resources and economic development may transfer funds between and among the appropriations for the operation of the state park system [through June 30, 2012]. The commissioner shall submit a report on a quarterly basis to the fiscal committee of the general court, the governor and council, and the chairmen of the house and senate executive departments and administration committees, the chairman of the resources, recreation and development committee, and the chairman of the wildlife, fish and game and agriculture committee of all transfers made under this paragraph. RSA 9:17-a and RSA 9:17-c shall not apply to transfers made under this paragraph.

II-a. Notwithstanding RSA 21-I:17-a, I, the director of the division of parks and recreation may make purchases using field purchase orders for expenditures of up to $2,000 for the state trail system and facilities [through June 30, 2012].

II-b. The commissioner of the department of resources and economic development may transfer funds between and among the appropriations for the bureau of trails [through June 30, 2012]. The commissioner shall submit a report on a quarterly basis to the fiscal committee of the general court, the governor and council, and the chairmen of the house and senate executive departments and administration committees, the chairman of the resources, recreation and development committee, and the chairman of the wildlife, fish and game and agriculture committee of all transfers made under this paragraph. RSA 9:17-a and RSA 9:17-c shall not apply to transfers made under this paragraph.

VIII-a. Notwithstanding RSA 21-I:17-a, I, the director of the division of parks and recreation may make purchases using field purchase orders for expenditures of up to $2,000 for the state trail system and facilities [through June 30, 2012].

VIII-b. The commissioner of the department of resources and economic development may transfer funds between and among the appropriations for the bureau of trails [through June 30, 2012]. The commissioner shall submit a report on a quarterly basis to the fiscal committee of the general court, the governor and council, and the chairmen of the house and senate executive departments and administration committees, the chairman of the resources, recreation and development committee, and the chairman of the wildlife, fish and game and agriculture committee of all transfers made under this paragraph. RSA 9:17-a and RSA 9:17-c shall not apply to transfers made under this paragraph.

4 New Section; State Park Gifts and Donations Fund Established. Amend RSA 216-A by inserting after section 3-m the following new section:

216-A:3-n State Park Gifts and Donations; Account Established.

I. Notwithstanding any other provision of law to the contrary, individual gifts and donations not exceeding $2,500 in value in a fiscal year may be received by the division of parks and recreation without the approval of the governor or the governor and council. Individual gifts and donations exceeding $2,500 in value in a fiscal year may be received by the division of parks and recreation with the approval of the governor and council.

II. There is established an account within the division of parks and recreation to be known as the state parks gifts and donations account. Moneys in the state park gifts and donations account are nonlapsing and continually appropriated to the division of parks and recreation. All gifts and donations to the division of parks and recreation shall be deposited in this account, except gifts and donations made to the division in support of a specific program that has an established dedicated account which shall be deposited into the appropriate dedicated account and expended in accordance with the purpose of the dedicated account.

5 New Subparagraph; State Park Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (304) the following new subparagraph:

(305) Moneys deposited in the state park gifts and donations fund established in RSA 216-A:3-n.

6 Effective Date. This act shall take effect upon its passage.

SB 237-FN - FISCAL NOTE

AN ACT relative to field purchases and transfers of funds for the state park system and the bureau of trails, and the use of gifts and donations to the division of parks and recreation.

FISCAL IMPACT:

      The Department of Resources and Economic Development states this bill may increase state restricted revenue and expenditures by an indeterminable amount in FY 2012 and each year thereafter. There is no fiscal impact on county and local revenue or expenditures.

METHODOLOGY:

    The Department of Resources and Economic Development states this bill makes changes relative to field purchases and transfers of funds and establishes a new dedicated, nonlapsing, continually appropriated account to receive gifts and donations to the park system. The Department states this bill addresses efficiencies in operations. To the extent the Department directly receives an increase in cash donations to the state park gifts and donations fund, the Department may have an increase in restricted revenue and expenditures.
