HOUSE BILL 101
AN ACT relative to calculation of the local tax cap by the Newfound area school district.

This bill provides that the local tax cap calculated under RSA 32:5-b for the Newfound area school district in preparing the 2014 budget shall not include previous fiscal year lapsed balances brought forward.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT relative to calculation of the local tax cap by the Newfound area school district.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1:1 Findings. The general court finds that:
I. Chapter 234:6, Laws of 2011, provided for the adoption of local tax caps for towns and districts under RSA 32:5-c. The effective date of this enabling legislation was July 5, 2011.
II. On March 13, 2012 the Newfound area school district, by vote at its 2012 deliberative session, adopted the provisions of RSA 32:5-b. Implementing the tax cap for the Newfound area school district began with the preparation of the fiscal year 2014 budget.
III. The Newfound area school district is the only school district that has adopted the provisions of RSA 32:5-b.
IV. The implementation of this act is limited to the calculation of the Newfound area school district budget for fiscal year 2014 and has no further application.
1:2 Local Tax Cap; Newfound Area School District. For the purpose of determining compliance with the tax cap adopted under RSA 32:5-c by the Newfound area school district, the amount to which the tax cap shall be applied in preparing the budget committee’s 2014 fiscal year budget shall be the amount of local taxes raised for the 2013 fiscal year without reduction for any lapsed balances pursuant to RSA 32:7 brought forward to reduce taxes.
1:3 Effective Date. This act shall take effect upon its passage.
