STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT permitting manufactured housing parks and condominium associations to access dog registration records.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Lists of Licensed Dog Owners; Available to Manufactured Housing Parks and Condominium Associations. Amend RSA 466:1-d to read as follows:

466:1-d Lists of Licensed Dog Owners.

I. Except as provided in paragraphs II [and], III, and IV and RSA 466:11 and RSA 466:14, no dog registration records, information, or lists shall be sold, rented, transferred, or otherwise made available in whole or in part, in any form or format, directly or indirectly, to another person.

II. Dog registration records, information, or lists may be made available pursuant to a court order or in response to a request from the state, a political subdivision of the state, the federal government, or a law enforcement agency solely for use in official business. The request shall be on a case-by-case basis. Any information, record, or list received pursuant to this paragraph shall not be further transferred or otherwise made available to any other person or listed entity not authorized under this paragraph, except as provided in RSA 466:13.

III. Dog registration records, information, or lists may be made available in response to a request from the executive or administrative entity of a manufactured housing park, as defined in RSA 205-A:1, or condominium, as defined in RSA 356-B:3, V, solely for the purpose of ensuring that dogs owned by residents of the park or condominium are duly licensed in accordance with RSA 466 and vaccinated against rabies in accordance with RSA 436:100. Any information, record, or list received pursuant to this paragraph shall not be further transferred or otherwise made available to any other person or listed entity not authorized under this section.

IV. Without otherwise compromising the confidentiality of the files, nothing in this section shall prohibit a body or agency from releasing information relative to health or safety from investigative files on a limited basis to persons whose health or safety may be affected, or to a person or agency attempting to provide for the welfare of an animal.

2 Effective Date. This act shall take effect 60 days after its passage.
