AN ACT relative to abutter access over subdivided land.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to abutter access over subdivided land.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Subdivision Regulations; Easement Required. Amend RSA 674:36 by inserting after paragraph IV the following new paragraph:

V. The subdivision regulations of the planning board shall require that, if a property owner with no legal access to his or her property notifies the planning board that development of abutting property would block access to a public way which he or she has used to access such property for more than 5 years, the developer of the abutting property shall, as a condition of approval of plans for the development of 3 or more lots, deed to the property owner a 20-foot easement entitling the owner to access the public way and to maintain and improve the property to facilitate such access.

2 Effective Date. This act shall take effect 60 days after its passage.
