STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the powers of an executor or administrator to take control of a decedent’s social networking websites.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Executor or Administrator; Social Media Accounts. Amend RSA 553 by inserting after section 12-a the following new section:

553:12-b Executor or Administrator; Social Media Accounts. The executor or administrator of an estate shall have the power, where otherwise authorized, to take control of, conduct, continue, or terminate any accounts of a deceased person on any social networking website, any microblogging or short message service website, or any e-mail service website.

2 Effective Date. This act shall take effect January 1, 2014.
