STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT requiring the reporting of certain felony offenses by postsecondary educational institutions.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Reporting of Suspected Felony Offenses on Postsecondary Educational Institution Campus. Amend RSA 627 by inserting after section 8-b the following new section:

627:8-c Reporting of Suspected Felony Offenses on Postsecondary Educational Institution Campus.

I. Absent a memorandum of understanding with the state police or local law enforcement agency for the reporting and investigation of alleged felony offenses, a public or private college, university, or other postsecondary educational institution operating in New Hampshire shall promptly report all suspected felony offenses, as defined in 20 U.S.C. section 1092(f), the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, to a state or local law enforcement agency.

II. This section shall not apply to a public or private college, university, or other postsecondary educational institution operating in New Hampshire which has a law enforcement department with sworn officers for maintaining campus safety and security.

2 Effective Date. This act shall take effect 60 days after its passage.
